- Civilno društvo celog sveta poziva vlade da stave ljudska prava u središte razvoja
- Države ne uspevaju da uspostave vezu između održivog razvoja i zakonodavstva koje ograničava civilno društvo
- Vlade moraju da redefinišu odnose sa civilnim društvom i uključe ga kao partnera u sprovođenje ciljeva održivog razvoja.
Civilno društvo širom sveta daje značajan doprinos razvoju, a ciljevi održivog razvoja ne mogu se u potpunosti ostvariti ako se nastave napadi na civilno društvo i branitelje ljudskih prava.
Ovo je glasna poruka predstavnika organizacija civilnog društva iz 25 zemalja koji su se krajem maja sastali u Johanesburgu u Južnoj Africi kako bi razgovarali o uticaju ograničenja slobode okupljanja i udruživanja na održivi razvoj.
Pred Politički forum na visokom nivou – centralne platforme Ujedinjenih nacija za praćenje i reviziju Agende za održivi razvoj do 2030. i ciljeva održivog razvoja – koji se održava od 9. do 18. jula u Njujorku, dole potpisani predstavnici civilnog društva pozivaju vlade da stave ljudska prava u središte razvoja.
Grupa se sastala u Johanesburgu u vreme kada su ograničenja građanskog prostora – prostora za delovanje civilnog društva – dosegla alarmantne razmere. Izveštaji otkrivaju da je civilno društvo pod ozbiljnim napadima u 111 zemalja, uz porast ubistava branitelja ljudskih prava koji ostvaruju svoje pravo da se okupljaju i udružuju u miru. Pitanje prekida protesta i okupljanja i prekomerna upotreba sile od strane policije i policijskih službenika predstavlja veliki problem za mnoge grupe koje podržavaju ovo saopštenje.
Istražujući odnos između slobode okupljanja i udruživanja, društveno-ekonomskog razvoja i ljudskih prava, učesnici sastanka u Johanesburgu izrazili su ozbiljnu zabrinutost zbog napada s kojima se suočavaju od strane državnih i nedržavnih aktera na redovnoj bazi i visokog nivoa nekažnjavanja počinitelja ovih radnji.
Grupa je primetila da, prema njihovom iskustvu, njihove vlade prave razliku između ljudskih prava i razvoja – često tretirajući aktiviste koji se bave temom ljudskih prava kao potpuno odvojene od razvojnih pitanja. Vlasti ih čak optužuju da imaju anti-razvojne tendencije.
Ova nepovezanost često znači da vlade vrše kontrolu nad ciljevima održivog razvoja, da sarađuju sa nedržavnim akterima, uključujući privatne korporacije i često isključuju stavove civilnog društva kada pokreću razvojne projekte. Dok je većina branitelja ljudskih prava na meti zbog svojih kampanja, oni koji zagovaraju prava na zemljište, zaštitu životne sredine i autohtono stanovništvo su najviše ciljani.
Ubrzo nakon sastanka u Johanesburgu, dvoje branitelja ljudskih prava – Ryan Hubilla i Nelly Bagasala iz filipinske grupe za zastupanje ljudskih prava Karapatan – brutalno su ubijeni zbog svog rada. Pre ubistava, osoblje Karapatana nadzirali su vojska i policija.
Politički forum na visokom nivou će razmotriti šest ciljeva održivog razvoja, uključujući one koji promovišu smanjenje nejednakosti unutar i među zemljama, aktivnosti na klimatskim promenama, inkluzivno i ravnopravno kvalitetno obrazovanje i pristup pravdi za inkluzivne i odgovorne institucije. Nažalost, pitanja koja su na razmatranju su u srcu tekućih ograničenja od strane državnih i nedržavnih aktera.
Samo tokom 2019. godine, mirni protesti protiv povećanja troškova života i sve većih nejednakosti bili su nasilno potisnuti u Sudanu, Zimbabveu, Nikaragvi i Venecueli; studentski protesti u Liberiji bili su sprečeni; i demonstracije protiv pogrešnih sudskih procesa u Kamerunu bile su nasilno potisnute.
Države često gledaju usko na razvoj kada ga smatraju izgradnjom infrastrukture i eksploatacijom prirodnih resursa. Zato targetiraju one koji izražavaju zabrinutost zbog nedostatka konsultacija sa zajednicom o infrastrukturnim projektima ili o uticaju na životnu sredinu kada korporacije više brinu o profitu nego o interesu zajednice prilikom eksploatacije prirodnih resursa. Vlade takođe ne uspevaju da uspostave veze između održivog razvoja i upotrebe restriktivnih zakona kako bi se potkopao rad civilnog društva na različite nedemokratske načine.
Uoči Političkog foruma na visokom nivou, moramo naglasiti da nema razvoja bez ljudskih prava. Organizacije civilnog društva koje rade na različitim tematskim područjima daju značajan doprinos razvoju, a ciljevi održivog razvoja ne mogu se u potpunosti ostvariti ako se nastave napadi na civilno društvo i branitelje ljudskih prava. Donosioci odluka moraju shvatiti da branitelji ljudskih prava nisu nastrojeni protiv vlada, već da postoje da podrže zakone koji ne krše ljudska prava.
Sedam branitelja ljudskih prava koji rade na pitanjima od ekonomskog razvoja do razvoja zajednice, inicijativa za borbu protiv korupcije i prava žena i devojaka trenutno žive u strogim uslovima i pod brojnim restrikcijama u Zimbabveu nakon što su uhapšeni zbog učešća u radionici za izgradnju kapaciteta na Maldivima.
Slobode okupljanja i udruživanja su ključne za rad svih organizacija civilnog društva, uključujući formalna i neformalna udruženja i omogućavaju ljudima iz različitih sredina da sarađuju.
U svetlu ovih ograničenja pozivamo države da:
- Izmene, ukinu i modifikuju restriktivne zakone i propise koji su usmereni protiv civilnog društva i sloboda udruživanja i okupljanja i osiguraju da su ti zakoni u skladu sa međunarodnim standardima ljudskih prava.
- Zaustave praksu targetiranja branitelja ljudskih prava, aktivista i drugih predstavnika civilnog društva, prestanu da im pripisuju lažne etikete i osiguraju da se njihova prava poštuju i štite, kao što se štite i poštuju prava svakog drugog građanina.
- Preformulišu odnose između države i civilnog društva u odnosu na implementaciju ciljeva održivog razvoja kako bi se osiguralo da se civilno društvo smatra ravnopravnim partnerom u ostvarivanju ciljeva i da se tako i tretira.
- Osiguraju da su ljudska prava na svim nivoima u središtu svih razvojnih inicijativa i ishoda i garantuju mirna i inkluzivna društva, pristup pravdi i odgovornim institucijama i smanjenu nejednakost.
